Seven things that decide a condominium purchase

Florida's condominium rules changed substantially after the Surfside collapse, and the market is still absorbing the effects. These are the items that determine whether a building is a sound purchase or an inherited liability.

Milestone Inspections

The report that tells you what the building actually is.

Florida requires a milestone structural inspection for condominium and cooperative buildings three stories or higher, performed by a licensed engineer or architect, beginning when the building reaches 30 years of age and repeating every 10 years thereafter. Local enforcement agencies may require inspection earlier — at 25 years — where coastal conditions warrant it, which is directly relevant on a barrier island.

A Phase 1 inspection is visual. If it identifies substantial structural deterioration, a Phase 2 inspection follows and can involve destructive testing. What you want to see is a completed Phase 1 with no Phase 2 triggered — and if Phase 2 was triggered, you want the findings, the remediation plan, and how it is being funded.

Request the report itself, not a summary from the listing agent. This legislation has been amended more than once since 2022; confirm current requirements and deadlines with the association and your own counsel rather than relying on any general description, including this one.

Structural Integrity Reserve Study

Reserves can no longer be waived away.

A Structural Integrity Reserve Study (SIRS) is required for condominium buildings three stories or higher and must be updated at least every 10 years. It establishes reserve funding for the components that actually fail expensively: roof, load-bearing walls, floor, foundation, fireproofing, plumbing, electrical, waterproofing and exterior painting, windows and exterior doors.

The critical change is that associations can no longer vote to waive or underfund reserves for SIRS components the way many did for decades. Buildings that had been deferring have had to raise assessments, sometimes sharply, and some have levied large special assessments to catch up. That adjustment is still working through the market.

For a buyer this is straightforward: obtain the SIRS, compare recommended funding against actual funding, and treat any gap as a future assessment you will be paying. A low monthly fee in an underfunded building is not a saving — it is a deferred bill.

Reserves, Budget & Assessments

A beautifully renovated unit in an underfunded building is a bad purchase.

Pull the current operating budget, the reserve schedule and funding level, the assessment history for the last five years, and any assessment currently contemplated but not yet levied. Then read the last two years of board meeting minutes — problems surface in minutes long before they appear in a budget.

Also get the insurance declarations. Coastal association premiums have moved substantially, and a building carrying a large deductible or thin coverage is transferring risk to owners whether or not anyone says so out loud.

Finally, check the owner-occupancy ratio and any pending litigation. Both affect financing: some lenders will not lend in buildings with high rental concentration, significant litigation, or delinquency above certain thresholds — which affects your resale pool even if you are paying cash.

Ocean Frontage & Position

Direct oceanfront, ocean view, and ocean access are three different things.

A building's relationship to the water is the largest single driver of value, and the language is used loosely. Direct oceanfront means the building sits on the beach with nothing between it and the Atlantic. Ocean view means a sightline, which may cross land the association does not own. Ocean access means neither — it means you can get to the beach.

Within a direct oceanfront building, position drives the rest: floor height, exposure, and whether the view is direct or angled. A corner residence with dual exposure on a high floor commands a substantial premium over an identical floor plan four levels below, and that gap holds on resale. Balcony depth and whether it is usable in wind matter more than buyers expect on this coast.

Amenities & What They Cost

Every amenity is a line in the budget and a future reserve item.

Pools, fitness rooms, elevators, garages, docks, and gated entries all appear in the monthly fee and again, later, in the reserve study. That is not an argument against amenities — it is an argument for knowing which ones you will use.

A boutique building with no amenity deck carries lower fees but spreads major repairs across fewer owners, so a roof replacement lands harder per unit. A large building spreads cost more thinly but has more to maintain. Neither structure is inherently better; the question is whether the fee matches what the building actually has to fund.

Rules, Rentals & Pets

Read the recorded documents, not the marketing.

Short-term rental rules vary meaningfully across Brevard's beachside municipalities, and associations layer their own restrictions on top — many prohibit rentals under 30 days, some under a year, and some cap the number of units that may be rented at all. Never assume a rental strategy is viable.

The same applies to pets, vehicles, renovation approvals, and guest occupancy. These live in the recorded declaration and rules, which the association must provide. Read them during your inspection period, because they are not negotiable after closing.

Insurance & Financing

The building's insurability becomes your resale problem.

You will carry an individual HO-6 policy for the interior, but the association's master policy covers the structure — and its cost, deductible, and adequacy flow directly into your fees and your risk. Coastal association premiums have risen substantially, and it shows up in budgets.

Financing is the other half. Lenders evaluate the building as well as the borrower: reserve funding, delinquency rates, rental concentration, litigation, and insurance adequacy can all make a building non-warrantable, which shrinks your future buyer pool to cash. Ask your lender to review the building early, not after you are under contract.

A note on Florida condominium law. The milestone inspection and reserve funding statutes have been amended more than once since 2022, and deadlines and thresholds have shifted.
